These Terms of Service ("Terms") govern your use of the CardCove website and your purchase of products from CardCove.
By accessing or using the CardCove website, creating an account, or placing an order, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law.

CardCove aims to ensure that product descriptions, photographs, prices, availability and other information displayed on the website are accurate.

4. Pokémon TCG Products
Pokémon TCG products may contain randomly selected cards.
CardCove does not guarantee specific cards, rarities, pull rates or outcomes from legitimately sealed products.
For example, purchasing a sealed booster box does not guarantee that the box will contain a particular rare, illustration rare, special illustration rare, Pokémon or other card.
CardCove does not reseal or intentionally alter legitimately factory-sealed products.
5. Individual Cards
Individual cards may vary in condition.
Where relevant, CardCove will provide information regarding:

Language;
-
Set;
-
Card number;
-
Edition;
-
Foiling;
-
Grading;
-
Defects or imperfections; and
-
Other relevant characteristics.
Customers should review the listing carefully before purchasing.
CardCove does not guarantee future market values or investment returns for any trading card or collectible.
6. Graded Cards
Where a card is described as graded, the grading has been performed by the grading company identified in the product listing.
CardCove does not control or guarantee the grading standards, processes or future grading decisions of third-party grading companies.
CardCove makes no guarantee that a card will receive a particular grade if it is subsequently submitted for grading.
7. Prices
All prices displayed on CardCove are in Australian dollars (AUD) unless otherwise stated.
CardCove reserves the right to correct pricing errors before an order is accepted or dispatched.
Prices may change without notice.
If a significant pricing error occurs, CardCove may contact the customer to confirm the order at the correct price or provide a refund for the affected product.
8. Orders
Submitting an order constitutes an offer to purchase the selected products.
An order confirmation does not necessarily mean that CardCove has accepted the order.
CardCove may cancel an order before dispatch where reasonably necessary, including where:

There has been a significant pricing or listing error;

The order appears fraudulent;

A payment cannot be verified;

An item has been incorrectly listed as available; or
-
A technical error has affected the order.
If CardCove cancels an order after payment has been received, the relevant amount will be refunded.
9. Payment
CardCove accepts the payment methods displayed at checkout.
Payments must be authorised before an order is dispatched.
CardCove does not store complete payment card details where payment processing is handled by a third-party payment provider.
Customers must not use fraudulent, stolen or unauthorised payment methods.
10. Shipping
CardCove ships orders to the destinations available during checkout.
Customers are responsible for providing an accurate delivery address.
Delivery estimates are provided as estimates only and may be affected by circumstances outside CardCove's control, including postal delays, weather, natural disasters, strikes or other events affecting delivery services.
Where tracking is provided, customers can use the tracking information supplied by CardCove or the relevant delivery provider.
11. Returns and Refunds
Returns and refunds are governed by the CardCove Returns & Refunds Policy.
Nothing in that policy or these Terms limits a customer's rights under the Australian Consumer Law.

12. Pre-Orders
Products identified as pre-orders will have an estimated release or dispatch date where available.
Release dates provided by manufacturers or distributors may change.
CardCove will make reasonable efforts to communicate material changes to pre-order availability or release dates.
Pre-order payment and cancellation arrangements will be specified on the relevant product listing.
13. Accounts
Where CardCove permits customers to create accounts, customers are responsible for:

Maintaining the confidentiality of their login credentials;

Providing accurate information;
-
Keeping account information up to date; and
-
All activity undertaken through their account where the customer has failed to maintain appropriate security.
Customers must notify CardCove if they believe their account has been compromised.
CardCove may suspend or terminate accounts involved in fraud, abuse, unlawful activity or serious breaches of these Terms.
14. Promotions and Discount Codes
Promotional offers and discount codes may be subject to additional terms displayed with the relevant promotion.
Unless otherwise stated:

Discount codes cannot be exchanged for cash;

Only one discount code may be used per order;

Discounts cannot be applied retrospectively;

Promotions may have minimum purchase requirements; and

CardCove may withdraw a promotion where reasonably necessary.
Promotions remain subject to applicable Australian Consumer Law requirements.
15. Intellectual Property
Unless otherwise stated, the CardCove website and its original content, branding, logos, graphics, text, photographs, designs and other materials are owned by or licensed to CardCove.
You must not reproduce, modify, distribute, sell or commercially exploit CardCove's original content without written permission.
Pokémon, Pokémon TCG, associated characters, names, logos and other intellectual property are owned by their respective rights holders.
CardCove does not claim ownership of third-party intellectual property.
16. User-Submitted Content
Where customers submit reviews, photographs, comments or other content to CardCove, they must ensure that the content:

Is accurate to the best of their knowledge;

Does not infringe another person's rights;

Does not contain unlawful, threatening, abusive or defamatory material;

Does not contain malicious software; and
-
Is not submitted for fraudulent or misleading purposes.
By submitting content, you grant CardCove a non-exclusive, royalty-free licence to use, reproduce and display that content for legitimate business and promotional purposes, subject to applicable law.
CardCove may remove content that breaches these Terms or is otherwise inappropriate.
17. Prohibited Activities
You must not use CardCove to:

Commit fraud;

Launder money;
-
Use stolen payment methods;
-
Manipulate promotions;
-
Create multiple accounts to circumvent restrictions;

Abuse refund or return processes;
-
Submit false information;
-
Attempt to exploit website vulnerabilities;

Interfere with website functionality; or
-
Engage in unlawful activity.
CardCove reserves the right to cancel transactions and restrict accounts where there are reasonable grounds to suspect fraudulent or abusive activity.
18. Third-Party Services
CardCove may use third-party services including payment processors, shipping providers, Shopify, eBay, analytics providers and other technology providers.
Use of third-party services may be subject to the third party's own terms and privacy policies.
CardCove is not responsible for the independent operation, availability or policies of third-party services to the extent permitted by law.
19. Website Availability
CardCove aims to keep the website available and operational but does not guarantee uninterrupted or error-free access.
The website may occasionally be unavailable due to:

Technical issues;

Cybersecurity incidents;

Hosting problems; or

Circumstances outside CardCove's reasonable control.
20. Limitation of Liability
To the maximum extent permitted by law, CardCove is not responsible for indirect or consequential loss arising from the use of the website or purchase of products.
Nothing in these Terms excludes, restricts or modifies any liability or consumer guarantee that cannot legally be excluded, restricted or modified under Australian law.
Where a limitation of liability is permitted by law, CardCove's liability will be limited to the extent permitted by applicable law.

CardCove may collect and use personal information necessary to process orders, provide customer support, deliver products, operate the website, prevent fraud and otherwise operate the business.

Updated Terms will be published on the CardCove website with a revised "Last updated" date.
The Terms applicable to an order will generally be those in effect when the order was placed, subject to any rights that cannot legally be excluded or modified.

These Terms are governed by the laws of Queensland, Australia.
Any disputes will be subject to the applicable courts and tribunals of Queensland, Australia, subject to any mandatory rights or dispute-resolution processes available under Australian law.
